Regulated Names Policy and Procedure

This document sets out .my
DOMAIN REGISTRY’s policy and procedure regarding Regulated
Names.

| 2. |
Regulated Names are names prescribed
by statute which may only be used subject to the necessary
qualifications, consents, licences and/or permissions having
been obtained from the relevant government ministry, department,
agency or regulatory authority, as may be applicable to .my
DOMAIN REGISTRY.

| 3. |
A Regulated Name may only be used as
a domain name subject to the necessary qualifications, consents,
licences and/or permissions having been obtained by the Registrant
from the relevant government ministry, department, agency
or regulatory authority.

| 4. |
.my DOMAIN REGISTRY and its Resellers
will rely on the Registrant’s warranty at the time of
registration that the Registrant is in full compliance with
all of .my DOMAIN REGISTRY’s rules, regulations and
policies. If this is found to be untrue at any time, .my DOMAIN
REGISTRY reserves the right to delete the domain name in question
and/or take such further action as may be necessary.

Government ministries, departments, agencies
or regulatory authorities that find that a Regulated Name
has been registered as a domain name by a Registrant without
meeting the necessary qualifying criteria, or obtaining their
consent, licence and/or permission, as applicable, may lodge
a complaint with .my DOMAIN REGISTRY by way of .my DOMAIN
REGISTRY’s complaints process by sending an e-mail to
agency-request@domainregistry.my

Where a complaint has been lodged with
.my DOMAIN REGISTRY regarding the registration of a Regulated
Name as a domain name, in compliance with .my DOMAIN REGISTRY’s
complaints process, .my DOMAIN REGISTRY will take the following
action:

a. |
Will lock the domain name
(i.e. in order to prevent any deletion and transfer
involving the domain name).

b. |
Will notify the Registrant of the complaint.
|
| |
c. |
Will give the Registrant 7 working
days to revert with certified proof of the Registrant
being qualified to use the Regulated Name complained
of, i.e. certified proof of the necessary qualifications,
consents, licences and/or permissions from the relevant
government ministry, department, agency or regulatory
authority. To be considered “certified”,
the said proof must be affirmed and validated before
a Commissioner of Oaths / Notary Public.

d. |
Failing receipt of a response from
the Registrant, together with the necessary qualifications,
consents, licences and/or permissions, the domain
name will be suspended for a period of 30 days.

e. |
If .my DOMAIN REGISTRY receives a
response from the respondent within the stipulated
7 days, together with the necessary qualifications,
consents, licences and/or permissions, .my DOMAIN
REGISTRY will confirm the same with the relevant government
ministry, department, agency or regulatory authority
and if confirmed that everything is in order, .my
DOMAIN REGISTRY will take no further action and release
the lock on the domain name.

| 7. |
Where a domain name has been suspended,
the Registrant of the domain name may file an application
with the relevant government ministry, department, agency
or regulatory authority for their consent, licence and/or
permission to use the Regulated Name complained of, which
application must be filed WITHIN the 30 day suspension period.

| 8. |
If at the end of the 30 day suspension
period:

a. |
my DOMAIN REGISTRY has
failed to receive a response from the Registrant,
together with the necessary qualifications, consents,
licences and/or permissions, .my DOMAIN REGISTRY will
proceed to delete the domain name subject to Clause
10.

b. |
the relevant government ministry,
department, agency or regulatory authority confirms
that the Registrant’s application has been lodged
with them and is pending approval, .my DOMAIN REGISTRY
will reinstate the domain name but will maintain the
lock for the duration of the approval process.

c. |
the relevant government ministry,
department, agency or regulatory authority confirms
that the Registrant’s application has been approved,
no further action will be taken by .my DOMAIN REGISTRY
and the lock will be released.

d. |
the relevant government ministry,
department, agency or regulatory authority confirms
that the Registrant’s application has been rejected,
.my DOMAIN REGISTRY will proceed to delete the domain
name subject to Clause 10.

| 9. |
If the application filed pursuant to
clause 8(b) is successful (as to be notified by the relevant
government ministry, department, agency or regulatory authority
to .my DOMAIN REGISTRY), no further action will be taken by
.my DOMAIN REGISTRY and the lock will be released. If the
application is unsuccessful (as to be notified to .my DOMAIN
REGISTRY by the relevant government ministry, department,
agency or regulatory authority), .my DOMAIN REGISTRY will
proceed to notify the Registrant and delete the domain name
subject to Clause 10.

| 10. |
Prior to deleting the domain name, .my
DOMAIN REGISTRY will reserve the domain name for a period
of fourteen (14) days (“reservation period”) and
will simultaneously notify the relevant government ministry,
department, agency or regulatory authority to lodge an application
for the said domain within the reservation period. Should
no application for the said domain be received within the
reservation period, .my DOMAIN REGISTRY will proceed to delete
the domain name. Deletion equals release of the domain name
into the public pool on a first come and first served basis.

| 11. |
The continued registration of the domain
name is subject at all times to the Registrant’s payment
of the annual renewal fees when it becomes due. Failing renewal,
the domain name will lapse and .my DOMAIN REGISTRY will proceed
to delete the domain name subject to Clause 10.
|
| 12. |
There shall be no refunds of any domain
name registration fees to the Registrant.
